The basis for the processing of your personal data is art. 6 sec. 1 lit. b) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119/1, hereinafter referred to as „GDPR”), which states that the processing of personal data is legally permitted if it is necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject before concluding a contract. The basis for the processing of your personal data to the extent that the processing is necessary to fulfill a legal obligation incumbent on the administrator is simultaneously Article 6 paragraph 1 letter c) of the GDPR, and to the extent that the processing is necessary for the purposes resulting from legitimate interests pursued by the administrator or by a third party is Article 6 paragraph 1 letter f) of the GDPR.

Your personal data are processed for the purpose of providing comprehensive brokerage services in the search for real estate by the Administrator, and then for the purpose of mediating in the conclusion of a reservation agreement, preliminary agreement and the actual agreement transferring ownership of the real estate, offered by the seller of the real estate or the developer to you, mutual transfer of offers for sale and purchase of real estate and creation of a database of potential buyers of real estate to whom offers for the purchase of real estate offered for sale by the Administrator’s contractors will be directed, providing comprehensive economic information as part of the services offered by the Company, and also forwarding information to the relevant entities in the event of an event concerning you.

Moreover, the processing of your personal data takes place for the purpose of establishing contact, presenting and forwarding the offer of the Third Party (seller or developer) electronically or in direct contact. In addition, the law requires the processing of your personal data for tax and accounting purposes.

The processing of personal data for the purposes of the above services falls within the scope of the Company’s business activity, disclosed in the National Court Register.

The legitimate interests pursued by the Company consist in conducting video monitoring on the Company’s premises related to ensuring security and offering (marketing) services, including providing comprehensive economic information about the services offered by the Company.

Personal Data will be processed by the Administrator for the duration of the service and the period in which the parties may pursue claims under the concluded agreement (having an account on the www.properbook.pl portal or completing and sending the form), until their limitation period expires or for the period specified by law, which obliges the Administrator to store personal data longer. In the event of account liquidation, the Administrator stores your data for a period not longer than 12 months, unless you have agreed to leave your personal data in the database. In such case, your data is stored until the consent is withdrawn, for no longer than 60 months from the date of its expression, and then it is subject to deletion within 1 month after its withdrawal.

We inform you that at any time you have the right to access the content of your personal data, to correct it, to request temporary or permanent suspension of its processing, correction, deletion or restriction of processing, the right to withdraw consent to its processing, the right to object to processing, the right to transfer data, and to lodge a complaint with the supervisory authority, i.e. the President of the Office for Personal Data Protection.

Your personal data may be transferred to recipients in third countries, i.e. outside the European Economic Area (EEA), however, this will be done with appropriate and proper safeguards. At the same time, we inform you that your personal data may be processed by Google LLC, Apple Inc. and Microsoft Corporation, in accordance with Art. 45 GDPR, regarding the use of computer software in the Company.

Your data will be processed in an automated manner, including profiling.

Providing personal data is voluntary, but it is necessary to achieve the purposes specified in the contact form. We kindly ask you to express your consent to the processing of personal data and to receive commercial information, including marketing information. PRINCIPLES OF PERSONAL DATA PROCESSING

The indicated principles of personal data processing, the observance of which is supervised by the Administrator, are:

the collected personal data are processed in accordance with the law, in a reliable and transparent manner;

personal data serve an established, specific and limited purpose;

minimization of data that must be appropriate for the established purpose;

correctness of the personal data obtained, with the possibility of updating them if necessary;

limited period of data storage;

data integrity and confidentiality, which ensure adequate protection of collected and processed personal data.

In light of the above, we would like to inform you that the processing of personal data is in accordance with the law if one of the conditions indicated in art. 6 sec. 1 letters a-c and f of the GDPR has been met, i.e.

WHO IS THE CONTROLLER OF YOUR PERSONAL DATA

The controller of your personal data (hereinafter referred to as the „Administrator”) is Properbook Sp. z o.o. with its registered office in Łódź, ul. In the case of completing the form on the portal www.properbook.pl, the Administrator processes personal data such as: e-mail address and data contained in the form, for the purposes of keeping statistics and directing direct marketing to people who have completed the form in question.

The Administrator processes personal data contained in the form or other documents posted by the User of the portal in their user account, for the purposes of mediating in the sale of real estate. In this respect, the processing is carried out on behalf of the Administrator’s contractor who posted a given offer for the sale of real estate. The Company acts as an intermediary in the exchange of personal data between the Portal User and the Developer, and at the moment of transferring this personal data to the Developer, it ceases to be their administrator, which at that moment becomes the Developer who received the offer to purchase the property. Thus, the Company is the administrator of this data only in the period from its entry into the portal www.properbook.pl until its transfer to the potential Developer.

The Company will be the Administrator of the above data for a period longer than until the moment of transferring this data to the Developer, in the event of expressing separate consent to leave the personal data in question in the database of users of the portal www.properbook.pl.

FOR WHAT PURPOSE AND ON WHAT BASIS ARE YOUR PERSONAL DATA PROCESSED

The legitimate interests pursued by the Company consist in offering its clients real estate brokerage services.

IN RELATION TO USERS OF THE PORTAL – in relation to unregistered Users.

Personal data is processed for the purpose of providing comprehensive real estate brokerage services, matching potential real estate buyers and developers, and mutually transmitting real estate sales and purchase offers, as well as creating a database of potential real estate buyers.

In addition, in order to provide comprehensive business information services as part of the services offered by the Company, but not requiring the creation of an account, personal data regarding activity on the www.properbook.pl portal, including data regarding viewed real estate sales offers, data regarding the session, device and operating system, browser, location and unique ID. In the case of using external applications such as the Messenger application, data shared on the Facebook profile and any data provided in messages sent via the Messenger application are also processed.

After creating an account, the Administrator processes your personal data that you provided to us voluntarily at the time of registration to the www.properbook.pl portal, provided in the registration form or in the case of an external service registering data provided by this service.

In the scope of direct contact, data regarding your image are also processed in order to provide information to the appropriate entities in the event of an event concerning you in connection with the conduct of video monitoring on the Company’s premises related to ensuring security.

In addition, the law requires the processing of your personal data for tax and accounting purposes, as well as for the purpose of pursuing claims.

We also process personal data obtained from you during the provision of our services, performance of the contract.

At the same time, it should be noted that you were not and are not obliged to provide us with any data, and their provision is not a statutory obligation. Failure to provide your data would not and will not result in any negative consequences for you, apart from the inability of the Company to provide services to you or to present an offer and conclude a specific contract with the Company. The Administrator also processes your personal data to the extent to which they are made publicly available by sources.

IN RELATION TO USERS OF THE PORTAL – in relation to registered Users.

SCOPE OF COLLECTED DATA

The Company collects your data only to the extent necessary to achieve the purposes indicated above. These include, in particular, first name, last name, address, contact telephone number, e-mail address.

The Company does not process personal data of special categories.

PERSONAL DATA PROCESSING TIME

Your personal data will be processed by the Company for the period necessary to implement the legitimate interests of you and the Company. After this period, your data may be stored by the Company for the duration of the account on the www.properbook.pl portal.

In the event of account liquidation, the Administrator stores your data for a period not longer than 12 months, unless you have agreed to leave your personal data in the database used by the Administrator to contact potential buyers of real estate and present you with offers from the Administrator’s contractors.

In the event that you agree to leave your personal data in the Administrator’s database, your data is stored until the consent is withdrawn, no longer than for 60 months from the date of its expression, and then it is subject to deletion within 1 month after its withdrawal. Thus, your personal data will be processed by the Company for the duration of the provision of services by the Company and the term of the agreement concluded with you, as well as after its termination for the purposes of pursuing claims in connection with the concluded agreement and fulfilling obligations arising from legal regulations, in particular tax and accounting regulations, however, at the latest until the limitation period for claims arising from the concluded agreement or the expiry of the deadlines indicated by the relevant legal regulations.

In the scope of offering (marketing) services, including providing comprehensive economic information about the services offered by the Company, your data will be processed until you object to such processing or withdraw the relevant consent.

In the event of not concluding an agreement, the Administrator stores your data for a period not longer than 12 months.

RIGHTS OF PERSONS WHOM THE DATA CONCERN

In connection with the processing of your personal data, you have the right to request rectification (correction) and supplementation, deletion, restriction of processing, transfer, access to personal data provided to the Company.

In addition, you have the right to withdraw your consent to the processing of your personal data at any time without affecting the processing that was carried out on the basis of consent before its withdrawal. You also have the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.

You also have the right to object when there are reasons related to your special situation, and the processing of data is based on the necessity for the purposes resulting from our, so-called legitimate interests or at any time to the processing of your data for the purposes of direct marketing, including profiling, and after filing this objection we will no longer be allowed to process your data for such purposes.

WHO CAN BE THE RECIPIENT OF YOUR PERSONAL DATA

The main recipients of your personal data are potential sellers of real estate, developers, interested in offering you real estate for sale.

The recipients of your personal data are cooperating entities, including the so-called Processors in connection with the implementation of activities on behalf of the Company, on its behalf, courier companies and postal services, law firms that may conduct proceedings on behalf of the Company and entities providing media necessary to provide the Company’s services. The recipients of your personal data may also be courts and other authorities in the event of pursuing claims arising from agreements concluded with the Company.

Your personal data may be transferred to recipients in third countries, i.e. outside the European Economic Area (EEA), however, this will be done with appropriate and proper safeguards. PROFILING AND AUTOMATED DECISIONS REGARDING PERSONAL DATA

The Company may make automated decisions based on your personal data, including profiling referred to in art. 22 sec. 1 and 4 of the GDPR. Profiling conducted by the Administrator consists in particular in assigning and matching personal data provided upon registration to the Portal and data provided in documents saved in the Account and data regarding activity on the Portal, registered and stored via cookies. The above information is used to create a user profile in the database, which is then used to present the best possible offer of sale of real estate to such user.

The Administrator makes every effort to provide all means of physical, technical and organizational protection of personal data against their accidental or intentional destruction, accidental loss, change, unauthorized disclosure, use or access, in accordance with all applicable regulations. In order to ensure the security of all users’ personal data, all connections between the user’s computer and the Company’s server are encrypted using the SSL (Secure Socket Layer) protocol. The databases used by our Company are additionally protected against access by third parties.

Your personal data are processed electronically and manually, in accordance with the methods and procedures related to the processing purposes referred to above. Providing personal data is voluntary, but is necessary to achieve the purposes indicated in this policy.

USE OF COOKIE FILES

The Company’s website uses cookies, which enable the identification of browsers used by users of the website while browsing it.
